Short answer. Yes. Modafinil is legal to possess in Ireland for personal use. It is regulated as a prescription-only medicine (POM) by the Health Products Regulatory Authority (HPRA), and it is not listed under any schedule of the Misuse of Drugs Acts 1977 to 2016. Possession of modafinil without a prescription is not, on its own, a criminal offence in Ireland. Supply (selling, distributing, or importing for the purpose of supply) is restricted by HPRA and Revenue enforcement.

HPRA classification: prescription-only medicine
The Health Products Regulatory Authority (HPRA) is the Irish national medicines regulator. HPRA classifies modafinil as a prescription-only medicine. In practice this means:
- Pharmacies in Ireland will not dispense modafinil without a valid prescription written by a registered Irish medical practitioner.
- The most commonly registered brand in Ireland is Provigil 200 mg (modafinil), authorised through the EU centralised procedure and listed on the HPRA database.
- Off-label prescribing is a clinical decision made by your GP or specialist. Modafinil’s licensed indication in Ireland is narcolepsy. Other uses (shift-work sleep disorder, obstructive sleep apnoea with residual sleepiness) are prescribed off-label.

Misuse of Drugs Acts 1977 to 2016: not scheduled
Ireland’s controlled-drug law is the Misuse of Drugs Acts 1977 to 2016, supported by the Misuse of Drugs Regulations. The Acts schedule substances by their potential for harm and dependence. Cocaine, amphetamine, MDMA, and the benzodiazepines all sit somewhere in those schedules.
Modafinil does not appear in any schedule of the Misuse of Drugs Acts 1977 to 2016. It is not classified as a controlled substance under Irish law. That is the single most important fact to understand if you have been told otherwise on a forum or by an overseas source.
Because modafinil is not scheduled:
- An Garda Síochána has no controlled-drug offence to pursue for simple personal possession.
- A possession charge under the Misuse of Drugs Acts is not available to the prosecution.
- The regulatory authority over modafinil sits with HPRA, not the Garda Drugs Unit.
This is the legal basis for the everyday reality that personal-use possession of modafinil in Ireland is treated very differently from the way controlled drugs are treated.
Possession vs supply
Irish medicines law draws a sharp line between possession and supply:
- Possession of a prescription-only medicine without a prescription is not, by itself, a criminal offence under either the Misuse of Drugs Acts or the principal medicines regulations. The offences that exist are aimed at supply.
- Supply (selling, distributing, importing for the purpose of supply, or advertising for supply) of a prescription-only medicine without HPRA authorisation is a regulatory offence and can be prosecuted by HPRA.
In plain language: if you have a small quantity of modafinil for your own personal use, you are in a very different legal position to someone running a wholesale operation. HPRA enforcement focus is on the supply side. We are stating the legal position, not giving you advice on how to source modafinil outside the prescription system.
What customs actually does
Modafinil parcels arriving in Ireland are inspected by Revenue Commissioners customs, not by UK Border Force. Ireland is the only English-speaking EU member state after Brexit, so the post-Brexit customs path is genuinely different from the UK path.
Practical points:
- Intra-EU parcels move under EU single-market rules. Most modafinil generics ship from outside the EU (India and Singapore are the common origins), so intra-EU rules rarely apply.
- Non-EU parcels containing a prescription-only medicine without an accompanying prescription are subject to HPRA enforcement at the border. The typical Revenue and HPRA response to a non-commercial quantity is to seize and destroy the package and send a notification letter to the addressee.
- An Post handles last-mile delivery once a parcel has cleared Revenue customs. An Post itself is not the inspecting authority.
