Will Customs Seize Modafinil? Seizure Risk and Personal Use Import Rules by Country
What customs agencies and regulators in the United States, Australia, Canada, the United Kingdom and China actually say about importing modafinil for personal use, how much international mail gets inspected, and why some parcels are held or seized.
Key findings

- Australia requires a prescription at the time of import. Under the TGA Personal Importation Scheme, a prescription-only medicine needs a valid Australian prescription or written authority when it arrives, and imports that do not meet the conditions may be seized.3
- The UK treats it as a prescription medicine, not a listed controlled drug. Modafinil does not appear on the Home Office list of the most commonly encountered drugs controlled under the Misuse of Drugs legislation.5
- China treats it as a strictly controlled psychotropic drug. Chinese customs officers have seized modafinil found in inbound mail, and state media describe it as a Class I psychotropic drug in China.9
Will customs seize modafinil ordered for personal use?
It depends on where the parcel is going, what the destination country’s rules say, and whether the parcel is one of the few that actually gets opened. Customs and border agencies screen international mail for prescription medicines, and a parcel of modafinil that does not meet the destination’s import rules can be held, seized, or destroyed. How often that happens is a different question from whether it is allowed, and the two get confused constantly.

United States: FDA mail screening and Schedule IV status
At US international mail facilities, Customs and Border Protection refers suspected FDA-regulated packages to FDA investigators. FDA has publicly estimated that it is able to inspect less than 0.18% of the packages assumed to contain drug products shipped through those facilities.1 That figure describes agency capacity across all drug-containing mail. It is not a seizure rate for modafinil orders, and it does not mean a parcel that is inspected will be released.
Modafinil is a Schedule IV controlled substance under US federal scheduling.2 Personal importation of unapproved or prescription drugs outside narrow FDA pathways is restricted under federal import rules, so an inspected parcel can be refused or detained. Why modafinil is a Schedule IV controlled substance
The Drug Enforcement Administration placed modafinil in Schedule IV through a final rule published in the Federal Register on 27 January 1999. The rule describes modafinil as a central nervous system stimulant that produces many of the same pharmacological effects and adverse reactions as classic psychomotor stimulants, but at higher doses, and notes that it was to be marketed as a prescription drug for excessive daytime sleepiness associated with narcolepsy under the trade name Provigil.8
The DEA found that modafinil has a low potential for abuse relative to Schedule III substances and a currently accepted medical use in the United States. The practical point for anyone ordering from abroad is in the rule’s summary: placement in Schedule IV makes the regulatory controls and criminal sanctions of that schedule apply to the manufacture, distribution, importation, and exportation of modafinil and products containing it.8 That is the legal basis on which a US customs officer can detain a modafinil parcel, whatever the odds of any single parcel being opened.
Australia: Schedule 4 and the Personal Importation Scheme
In Australia, modafinil is a Schedule 4 (prescription-only) medicine. The Therapeutic Goods Administration runs a Personal Importation Scheme that lets individuals import therapeutic goods for their own use or an immediate family member’s, provided every condition is met.3 For a prescription-only medicine, the TGA says you must hold a valid Australian prescription or written authority at the time of importation, the quantity must stay within the scheme’s supply limits, and the product must arrive in its original or clearly identifiable packaging.3
The TGA also states that electronic prescriptions (eScripts) cannot be accepted as written authority for importation, that a prescription obtained after the parcel is held does not count, and that imports which fail the conditions may be seized by Australian Border Force, with the loss of both the product and the money spent.3 Practical buyer context sits on our Modafinil Australia page.
Canada: CBSA and Health Canada border rules
Canada Border Services Agency memorandum D19-9-1 describes how the CBSA administers Health Canada acts and regulations at the border for certain controlled, prohibited, or regulated goods, including prescription and non-prescription drugs.4 Modafinil is handled as a regulated prescription medicine under that framework. The memorandum describes the rules the CBSA applies; it does not publish a success or seizure rate for personal modafinil imports, and neither does this page. United Kingdom: prescription-only medicine
In the UK, modafinil is a Prescription Only Medicine. It does not appear on the Home Office publication listing the most commonly encountered drugs currently controlled under the Misuse of Drugs legislation.5 That publication is a list of commonly encountered controlled drugs, not the full statute, so its absence is scheduling context rather than a guarantee of how any parcel will be treated. China: a strictly controlled psychotropic drug
China is the clearest example of a country where modafinil is not treated as an ordinary prescription medicine. In 2019 Xinhua reported that the customs office in Qingdao seized unlawfully smuggled modafinil found in inbound mail during a routine check, the first time that office had seized the drug. The report says modafinil has been under strict control in China as a Class I psychotropic drug, that it is mistakenly considered a “smart drug” for cognitive skills and concentration, and that China warns against mailing psychotropic drugs into and out of the country without approval.9
INTERPOL Operation Pangea: the global enforcement backdrop
INTERPOL’s Operation Pangea is a recurring multinational action against the illicit online sale of medicines, coordinating parcel seizures and the takedown of websites and online channels.7 It explains why customs agencies in many countries pay attention to pharmaceutical mail, but its totals are not modafinil-specific and should not be read as a seizure rate for personal orders.
